BGC Warns Tighter UK Gambling Rules May Fuel Black Market Growth

They believe this is going to be driven by stricter UK gambling regulation, high gambling taxation, and expanded affordability checks.[1] The trade body argues that policy decisions, though for the good, may strengthen the market value of criminal bookmakers operating outside the UK Gambling Commission oversight. [2]

The Reason for the Warning

The warning from the BGC comes from the ongoing changes to the Gambling Act. Measures under discussion or recently introduced include online stake limits for those aged 18-24 and 25 and over, increased remote gaming duty, tightened advertising rules, and more. They believe that with each revision, lawmakers could be unintentionally redirecting consumers to illegal platforms. [3]

Industry estimates referenced by the BGC suggest millions of UK consumers are already on unlicensed sites. They’ve even gone on to suggest billions of pounds are wagered on platforms outside of UK regulation. [4] These figures, however, haven’t been verified by the Gambling Commission. They are drawn from industry-commissioned research. 

How Black Market Operators Target UK Gamblers

The BGC has also mentioned that major events, like the Grand National, are what these unlicensed operators are targeting.[5] During these high-volume periods, it can be easy to convince a punter to bet outside the UKGC network. Better bonuses, odds, and so forth can be hard to pass up for such events.

These offshore platforms offer easy access to gambling as well. Licensed operators are required to carry out age verification checks, anti-money laundering checks, and user responsible gambling interventions. [6] Bookmakers outside the UKGC spectrum, however, operate outside these safeguards, which let them target vulnerable players. [7]

Balancing Consumer Protect and User Enjoyment 

The wider tension is between consumer protection objectives and maintaining a competitive regulated environment. That’s why the BGC is urging policymakers to weigh up the impact of their decision for all parties. The question shouldn’t just be “how do we make gambling safer?”, but it should be extended to “how do we make gambling safer and keep players in the UKGC-regulated market?”.

Without question, the debate is a sensitive topic. It’s not an easy one, either. For now, the BGC’s position is to keep players within the regulated market, whereas consumer protection groups and policymakers are more towards keeping players safe. Both are equally important, but unfortunately, without careful consideration for both, black markets could see an increase in users.
